Contract Terms and Conditions

I’m truly excited and honored to be considered in capturing your upcoming event! This contract terms and conditions are simply to ensure everyone is in agreement regarding the services we will be providing. Please feel free to contact me with any questions. House Rules
I, the videographer is limited by the guidelines of the venue and event officials and/or management. Client agrees to accept the technical results of their imposition on the videographer. Negotiation with the officials for moderation of guidelines is the Client's responsibility. Kaptured By Kulture Films will offer technical recommendations only.
Security Deposits and Cancellation Policy
The security deposit paid at the signing of the contract is non-refundable. If the Client cancels the terms of this contract more than 60 days prior to the event date, the remaining charges will not be owed and all payments already made above the security deposits will be refunded less material charges incurred up to time of cancellation.
Pre-event Consultation/Confirmation
The parties agree to a pre-event consultation/confirmation (by phone, email, or in person) at least one to two weeks before the event date in order to finalize the actual shooting times, locations, Client request list and confirmed timeline for the day.
Exhibition and Promotion/Model Release
Client grants Kaptured By Kulture Films, without restriction, use, re-use, publish and re-publish of the videos captured during the fulfillment of this contract, in whole or in part, separately or in conjunction with other videos, in any medium now or hereafter known, and for any purpose whatsoever, including (but not by way of limitation) illustration, promotion, advertising and trade. Client forfeits all claims to profits that arise from such use of videos. As a courtesy, Kaptured By Kulture Films will make every reasonable effort to contact the Client in the event that their videos are to be sold for profit, and the Client will be granted the right of refusal; however, if the Client is not able to be reached, this clause will serve as the full model release of all images as stated above in our Proposal
Completion Schedule
Video processing and USB/DVD-R creation take approximately two to three weeks. Expedited service is available upon request at additional cost.
Reservation
A signed contract and non-refundable retainer fee of 50% is required to reserve the specified coverage and date. The retainer fee is applied towards the total amount due.
Description of Services
All services to be rendered are listed in the attached invoice in detail. General services to be expected are as follows:
EVENT VIDEOGRAPHY RATE - $100-$200/hr
3-10 min length edit (1 revisions)
1 minute Social post (bonus)
Digital Delivery of edits via Dropbox
USB Drive delivery of raw footage + misc assets upon request
LIMITED LIABILITY
Kaptured by Kulture Films Company (KBKFCo) warrants and declares that every effort will be made to provide high quality video services. In the unlikely event that the videographer is injured or becomes too incapacitated to video the event, KBKFCo will make every reasonable effort to secure a replacement videographer. In such an event, Client releases KBKFCo from all terms of this contract and all payments received will be returned. If the situation should occur that a suitable replacement is not found, responsibility and liability is limited to the return of all payments received for the event. KBKFCo takes utmost care with respect to capture, transportation and processing of the digital files and videos. However, in the unlikely event that videos/files have been lost, stolen, or destroyed for reasons within or beyond KBKFCo’s control, the Company’s liability is limited to the prorated amount of the clips lost based on the percentage of total number of originals captured. In the unlikely event that a mechanical failure should occur to HFCo’s equipment and we are unable to provide the Client with the agreed upon video services and/or products, responsibility and liability is limited to the return all payments received for the event. KBKFCo and the Client agree that the Company is not responsible for any other damages, emotional or otherwise.
Acceptable Payment Types
Kaptured by Kulture Film accepts payment via Zelle, PayPal, Venmo, Apple pay or Cash.
